Understanding the New
Real Estate Rules • Part 2

In last month’s Kayenta Connection, we shared with you how recent changes required to be made by the National Association of Realtors (NAR) will impact Kayenta residents seeking to list their homes (or properties) for sale effective August 17, 2024 going forward. This month, Kayenta Homes & Properties (Jeff, Steve, and Naomi) would like to share with you how these new rules will impact home buyers. Buying a home is one of the largest financial transactions most people will ever undertake.

Here’s a summary of how the recent settlement and resulting changes to the rules will impact homebuyers:

  • Homebuyers will be required to sign a written agreement with their agent before touring a home, so it will be critically important for buyers to ensure that it reflects the terms they’ve negotiated with their agent and understand exactly what services and value will be provided, and for how much
  • This buyer agreement must include four (4) components around broker compensation:
    • A specific disclosure of the amount or rate of compensation the buyer’s agent will receive or how this amount will be determined
    • Compensation that is objective and not open-ended (i.e., X percent; X hourly rate; flat fee)
    • A term that prohibits the agent from receiving compensation that exceeds the amount or rate agreed to in the agreement with the buyer, and
    • A conspicuous statement that broker fees and commissions are fully negotiable and not set by law
  • Written agreements will apply to both in-person as well as virtual home tours
  • Buyers won’t need a written agreement if they’re only speaking to an agent at an open house or asking about services
  • The seller may agree to offer compensation to the buyer’s agent. This practice is permitted but the amount cannot be disclosed on the Washington County MLS (the local marketplace used by both buyer brokers and listing brokers to share information about properties for sale.
  • Buyers can still accept concessions offered by the seller, such as offers to pay their closing costs

The Ancient Life of Washington County

Join fan-favorite presenter, Jerry Harris, for an exploration of ancient life in Washington County. Jerry Harris is the Director of Paleontology Science Department at Utah Tech University, and is an advisor to the St. George Dinosaur Discovery Site at Johnson Farm.

Southwestern Utah is a desert today, but throughout prehistory, it’s been many different environments: under the ocean, a “sea” of sand dunes, a forested river floodplain, a freshwater lake, and more. Evidence for each of these comes from the layers of rocks preserved in Washington County. Each of these environments hosted its own unique fauna and flora, some of which are preserved as fossils. Their stories tell us about the ever-changing nature of our backyard.

Every October, thousands of art enthusiasts and families make their way to the Kayenta Art Village for our annual three-day FREE art festival in Ivins, Utah.

The Art in Kayenta Festival hosts a silent auction featuring original work from the attending artists and offerings from local businesses. Festival guests will have the exclusive opportunity to bid on selected art pieces. Proceeds benefit the Center For the Arts at Kayenta and the performing arts in Southern Utah.

Recap Kayenta Community Safety Meeting
held September 9, 2024

A huge thank you for the tremendous response we had to our September 9th Community Safety Meeting. Over 50 people attended in person and about 30 people called in via Zoom to hear from Sargent Hallman of the Santa Clara/Ivins Police Department and hear the results of our community survey. We are so thankful for the wonderful engagement and dialogue. It’s clear that our community is in a relatively safe current state – and that many committed to keeping it that way!

If you missed the meeting, have no fear! Please see the slide presentation containing current data and survey results, as well as the summary of recommended next steps both as individuals and as a community.

There was also significant concern expressed about fire safety. Many expressed a desire to have a similar presentation on the current state of fire risk in our community and actions we can take to improve fire safety. If you’re interested in helping bring that type of presentation to the Kayenta Community, please reach out to Laura at lamartin72@gmail.com.

Terrence and Deena Walters—The wild life of botanists

The world of a research botanist is both gigantic and microscopic, demanding field work in often remote locations and requiring the attention needed to capture the infinite details that are the foundation of scientific research. Terrence and Deena Walters entered that world when they met at Texas A&M University where they were both pursuing Ph.D.’s in botany and shared a Ph.D. advisor. Thus was launched a partnership that saw them working side by side on field work and completing multiple research projects and scientific papers over the decades.

An internationally known botanist, botany professor and former director of what is recognized as a world-class botanical center in Coral Gables, Florida, Terrence has enjoyed a wide-ranging career. He spent extensive time in China researching the millennia-old cycad plants, directing restoration efforts in Florida wildlife habitats that resulted in an increase in the alligator population, and working as manager of a research station in Colorado where he hiked three 13,000-foot peaks daily to record the number of flowering plants.

Deena devoted many years to the study of the Cucurbitaceae (the gourd family that includes watermelon, zucchini and squash), living in Venezuela for two years where she joined a collecting expedition in the Gran Sabana, one of the world’s highly valued ecological sites.  When Terrence was director of the Montgomery Botanical Center in Miami, Deena produced the center’s newsletter as well as The Cucurbit Network News, while joining other researchers on a variety of scientific projects, including scouting wild melon populations in the southern U.S.  Terrence assisted Deena with growing her research plants, as well as accompanying her on seed collection expeditions to Mexico.

The Walters found Kayenta when they began looking for a vacation home, ultimately retiring here in 2019. But retirement has not slowed them down. Terrence is lending his tremendous experience in dealing with invasive species to the work of the Desert Preservation Initiative, which he serves as secretary. “I have seen the impact of invasives have had on a global scale, on native species and sensitive and specialized ecological habitats,” he says. “After working with the USDA for 12 years attempting to reduce the entry of invasive species through United States entry ports, I wanted to continue my work to protect the truly beautiful and amazing SW Utah ecosystem we now call our home.”

Deena has put her expertise in Photoshop, developed over her years as a newsletter editor, to work in a new direction—adding artistic effects to the photos Terrence takes on his many hikes (he belongs to five hiking clubs).  “Since we’re both botanists, we were entranced by the various ghostly and warped shapes of the many barren trees that are found in the high desert landscapes,” Deena says. They soon developed a new business, Backcountry Trail Art, where the Walters sell prints, cards, books, and blankets featuring both their “deadwoods” and local geological features at the Tuacahn Saturday markets.

After many years of living the wild life of botanists, the Walters have found new ways to explore their many interests—botany, hiking, photography, creating art—in just one place, at home in Kayenta.

On Saturday, September 7th, Coyote Tales returned to Ivins City Park for the final show of their 2024 season. The venue could not have been more agreeable. The weather was pleasantly warm with a soft end-of-summer breeze and ample shade until dusk. And once the sun set, the canopy of trees surrounding the stage glowed with sweet string lights. Audience members brought along folding camp chairs, blankets and picnics which helped transform the baseball diamond into a proper theater.

Invited tellers, Robert Perkins, Wendy Chen, Elaine Morales, Kase Johnstun and Nan Seymour joined five mildly nervous but willing local storytellers who each captivated listeners with their takes on the evening’s theme, FIRST. Stories ranged from a tale about the first time a young boy heard the call of a whippoorwill, to a mother questioning her parenting choices as she competed in her first bodybuilding competition, to a pop-music-loathing father’s newfound appreciation for Taylor Swift. As expected, listeners relished every moment. Of course, Douglas Caputo was there to guide the evening with his usual charm and good humor.

Other highlights of the evening were the bluegrass music provided by Joe and Paula Ferario of Stillhouse Road and the FREE water and cookie station hosted by longtime Coyote Tales supporters, Kayenta Homes and Properties. We were delighted that independent bookseller, Tanya Parker-Mills of The Book Bungalow was also able to join us to sell copies of many of our invited teller’s works.

Coyote Tales events are intended to be about the shared connection between the teller and the audience. Each time a storyteller shares a tale, they are putting a call out to community – a community of listeners who recognize something in the telling that they can relate to. We believe that through this connection, an individual teller’s experience can become the audiences’ shared experience. In a very real way, a sea of ‘I’s” becomes our communal, WE.

Show us how you roll pie baking contest Judges ans Volunteers

The Annual Ivins Heritage Days Pie Baking Contest on September 7th had a record number of pies entered, and competition was tight.  Every pie was delicious. From sweet to savory, Ivins bakers really showed us how they roll.  The contest brought in a variety of pies from across Ivins. Kayenta residents, Sally McNeil-Blimling, Lois Hewett, Paul Andrews, Sara Dupre, Tina Fought, Lisa Bernath, Liz Fortney and Karen Baker all turned out inspired creations that won high praise from the judges. Resident Ivins City bakers were also there in full force. Shirley Blake, Heidi Blake and the husband-and-wife baking team of Abby and Dre Grossen all entered noteworthy pies that were not only beautiful but very tasty. The contest’s youngest entrant, Sydney Hanfield’s beautiful Apple Pie scored high marks for creativity and taste. It had a tender crust decorated with hand painted pastry leaves that surely demonstrated her pie baking prowess.

Who won? Sue Shives and her Huckleberry Peach Pie definitely stole the show. The well-balanced flavor paired with her expertly baked crust captured the blue-ribbon win and hopefully a place on your Thanksgiving table.  I am certain its pleasantly tart filling loaded with peaches and huckleberries (blueberries may be substituted) will be a welcome addition to your family’s holiday pie lineup. Last year’s Blue-ribbon winner, Kirra Dixon’s Strawberry Rhubarb Pie and Lisa Ganz’ luscious Key Lime Coconut Pie claimed second and third place respectively. Congratulations to all who entered and many thanks to Sue for sharing her winning recipe for our group this month.

If you have not joined the Virtual Dinner Party but would like to dine with us, please prepare this recipe – or any other – and share it with your family, friends and neighbors. It is our group’s firm belief that by preparing something good to eat and sharing it with those we love, we are participating in one of life’s greatest joys. VIRTUAL DINNER PARTY #98
SUE SHIVES’ BLUE RIBBON WINNING HUCKLEBERRY PEACH PIE

INGREDIENTS:
Crust: (enough for a double crust pie)
2 cups all-purpose flour
1 teaspoon salt
12 tablespoons COLD butter
5 – 6 tablespoons ice cold water

Filling:
3 cups huckleberries fresh or frozen
2 cups peaches peeled and sliced into eighths
3/4 cup sugar
3 tablespoons tapioca granules
1/2 teaspoon cinnamon

METHOD:
Prepare pastry:
Combine dry ingredients for crust in mixing bowl. Work in butter pieces using a pastry cutter or two knives until particles are the size of peas.

Sprinkle in water 1 tablespoon at a time, tossing with a fork after each addition. Mix lightly
until all flour is moistened and the mixture is crumbly. Add only enough water to make a cohesive mixture. (1 to 2 teaspoons of water can be added if needed.)

Gather dough together with hands; press firmly into a ball. Divide in half and shape into two flattened rounds. Wrap each round in plastic wrap and place in refrigerator for 30 minutes.

Roll out one of the chilled dough rounds with a rolling pin on a lightly floured surface. Be sure to roll dough from center to outside evenly in all directions into a 12″ to 13″ round.

Carefully place dough into pie pan making sure to press gently against bottom and sides of pan.
Refrigerate while you roll out top crust and make filling.

Roll second pastry disk into a 10″ – 11″ round on a slightly floured surface. Set aside.

Make filling and finish pie:

In a large bowl, stir together the huckleberries, peaches, sugar, tapioca granules, and cinnamon. Pour into prepared pastry line pie tin and carefully center the second pastry round over the filling.

Trim the edges of the strips flush with the dough of the underlying pie dish and press together firmly. Crimp the pastry decoratively using your fingers or the tines of a fork.

Bake for 35-45 minutes in a preheated 425-degree oven. You may want to cover with aluminum foil partway through baking to prevent excessive browning.

This class aims to maintain/improve Range of Motion, while also strengthening muscles and connective tissues, and improving balance.

Yin/Yang Yoga combines passive seated and supine stretches (Yin Yoga) with standing “Yang” poses (for example, Warrior 1 and 2, and standing balance poses).  There will be minimal up-down movement from seated/lying down to standing, and chairs will be available as props.  This class is suitable for all levels.

Inkas no kill Animal Supporters

INKAS – Ivins No Kill Animal Supporters

Ivins No-Kill Animal Supporters (INKAS) is a 501(c)3 organization and a Registered Utah Charity. It was founded in 2010 with the mission of providing support to Ivins Animal Shelter and Adoption Center, now the Santa Clara-Ivins Animal Shelter. In 2006 our shelter became the first no-kill municipal shelter in the state of Utah. Maintaining a no-kill shelter, as opposed to one that euthanizes animals after a set period of time, is more costly because the animal’s needs must be met at the shelter until they are reclaimed by their owners, adopted, or transferred to an animal rescue organization. Through a memorandum of understanding with Ivins City, INKAS provides support through veterinary care, specialty foods, and other needed supplies. Funds are raised through the sale of merchandise at various local events and through the donations of many generous animal lovers. You can help by designating INKAS as your charity on Amazon Smile or by donating on our website.

Ivins Night Sky launched on January 8th, 2019. We are a 100% volunteer, not-for-profit, citizen organization. We registered as a Utah nonprofit corporation in February 2019 and received 501(c)(3) tax-exempt status from the IRS in March.

Our mission is to improve, preserve, and protect the night sky over Ivins and our heritage of dark skies through environmentally responsible outdoor lighting, and to serve as a resource for City officials, residents, and businesses.

Centering the importance of nature and the mind, Kayenta’s Art Village outdoor space includes an Arboretum dedicated to “waterwise” landscaping and a Labyrinth built by local residents. Free for the public to enjoy.

If you love plants and gardening….

A phenomenal new resource is now available to guide you in creating your Kayenta landscaping, available on the Kayenta HOA website.

The Kayenta ACC Landscaping Committee has just released a new guide to plants currently suggested for use, listing plant characteristics such as typical height and width, growth rate and—perhaps most useful—whether the species is available at local nurseries.

There are links attached to each of the plant IDs and names which lead to images of the plants and in-depth information available online.

In addition, the guide specifies in what areas plants can be used, such as the natural area, the transitional area or in a courtyard. A “Notes” section includes other advice and things to know about a given plant.

This user-friendly Guide to Kayenta Plants is located in the ACC’s Landscaping Documents.

Shonto Point HOA Meetings
The Shonto HOA Board meets regularly during the year avoiding some summer months. All meetings are from 2:00 PM – 4:00 PM on the third Wednesday of the month in the Theatre for the Arts, located in the Kayenta Art Village.

Taviawk  HOA Board  Meetings
The Board plans to meet on the Thursday after the ACC meeting (which is the 3rd Tuesday of each month) bi-monthly at 9:30 am at The Management Group (formerly, F1 Property Management)

The Kayenta Concept

The Kayenta Concept is a philosophy that has steered the development of our exceptional community since its inception. The standards that underlie that concept are enforced by the Architectural Control Committee (ACC), which serves both the Shonto Point and Taviawk HOAs. The pre-amble to the 2021 ACC Handbook lays out the basics of the architectural rules that have been followed to create the homes and land-scape we live in.

When your home was designed the Kayenta Concept was front and center. The ACC reviewed your design to evaluate whether it followed the rules, and the ACC monitored construction of your home through landscaping and occupation, again, reviewing adherence to design and construction standards. When you received your occupancy permit and construction deposit refund from the ACC, on-going compliance with the Kayenta Con-cept became the responsibility of your HOA Board of Directors. Your Board has the authority to perpetuate the Kayenta Concept into the future and gladly accepts that role.

The Kayenta Concept is worth reviewing to remind us that what we have here has only happened because of the rules Kayenta developer Terry Marten set up to own, build and live in Kayenta. His vision and the governing documents he developed to achieve and maintain that vision established the Kayenta HOAs and gave them the responsibility and authority to enforce the CC&Rs that underlie the beauty and value we all enjoy
